Subject: H-1B Cap Update
Dear International Students,
The USCIS (US Citizenship and Immigration Service) has announced that the quotas for the H-1B cap have been reached for the fiscal year 2009 – covering the period October 1, 2008 to September 30, 2009. Both the general pool of 65,000 AND the 20,000 advanced degree cap numbers have been reached.

Because more petitions were received than there are available cap numbers, the USCIS will now carry out the random selection process (aka lottery) beginning with the 20,000 advanced degree petitions and moving on to the 65,000 available cap numbers. Petitions which are not selected in the random selection process will be returned to the employer or attorney with fees.
Students who are anxiously awaiting news of inclusion in this year’s cap should maintain contact with employers and/or follow any instructions from the employers regarding communications around the H-1B cap issue.
